Brief description:
This work examines the role of the insolvency court in insolvency proceedings in general and with regard to the creditors' meeting in particular. It examines the question of whether the insolvency court is primarily assigned regulatory tasks or whether, in addition, the protection of interests not represented in the insolvency proceedings must also be carried out by the insolvency court. The author deals with structural principles of insolvency law as well as the historical background and the function of insolvency proceedings in the economic system. Finally, the question is examined as to whether the system of minority protection standardized in the Insolvency Code is sufficient or whether it needs to be supplemented by the Insolvency Court.
